The UK Genuine Visitor Rule Explained

Guides

September 2026· UHA Legal Editorial Team

Most UK Standard Visitor visa refusals aren't about missing a specific document. They come down to the entry clearance officer not being satisfied you meet the "genuine visitor" requirement — a judgment call based on your whole application, not a single checkbox. Understanding what this test actually looks at is the difference between a strong application and a refused one.

What the Rule Actually Requires

Under the Immigration Rules, a genuine visitor must show they:

  • Genuinely intend a temporary visit, for a purpose permitted under the visitor route (tourism, visiting family, business, or certain paid engagements)
  • Intend to leave the UK at the end of their visit
  • Will not live in the UK for extended periods through frequent or successive visits
  • Can maintain and accommodate themselves and any dependents without working or accessing public funds
  • Are not in breach of any UK immigration laws

The difficulty is that these are assessed together, based on your whole file, not confirmed by any one document. Two applicants with identical bank balances can receive different decisions depending on how well the rest of their evidence supports genuine, temporary intent.

What Actually Convinces an Entry Clearance Officer

In practice, the strongest visit visa applications from Pakistan share a few features:

  • A consistent story. The stated purpose of the trip, the itinerary, the length of stay, and the financial evidence all point the same direction. Contradictions between the application form and supporting letters are a common refusal trigger.
  • Credible ties to Pakistan. Not just a job, but evidence that the applicant has something meaningful to return to — ongoing employment, a family role, property, or a business that requires their presence.
  • A realistic length of stay matched to the stated purpose. A six-month visit to "see family" without a clear reason for that duration invites more scrutiny than a two-week trip with a defined itinerary.

Where This Test Most Often Goes Wrong

We regularly see applicants focus entirely on proving they have enough money, while giving almost no attention to proving they intend to return to Pakistan. Both matter, and in our experience, weak evidence of ties to Pakistan is the more common reason for refusal, not insufficient funds.

If You've Already Been Refused on Genuine Visitor Grounds

A refusal citing the genuine visitor rule usually means the entry clearance officer wasn't persuaded by the overall picture, not that any single document was missing. Reapplying with the same evidence, slightly more of it, rarely changes the outcome. What tends to work is directly addressing the specific concern raised in the refusal letter.
